1. Definitions

Platform = European Bass Market website and related services

Operator = ALMA ART & MEDIA SERVICES – informacijske storitve Marko Loredan s.p., Slovenia, VAT SI22279725

User = any person accessing the Platform Seller = User publishing listings Professional

Seller = User acting in the course of trade/business

Private Seller = non-professional individual

Content = listings, text, photos, messages, data uploaded by Users

2. Nature of the Service (IMPORTANT)

European Bass Market is a neutral online hosting platform under EU law and the Digital Services Act.

The Operator’s role is strictly limited to providing technical infrastructure that allows Users to post listings and communicate.

The Operator:

• does not own, buy, or sell goods
• is not an agent, broker, reseller, dealer, or representative
• does not participate in negotiations
• does not determine prices
• does not verify goods
• does not handle payments
• does not arrange shipping
• does not resolve disputes

IN NO CASE does the Operator interfere in or become part of the sales process between Users. All contracts are concluded exclusively between Users.

3. Acceptance of Legal Documents

By creating an account or purchasing a membership, Users confirm acceptance of:

• These Terms & Conditions
• The Privacy Policy
• The Cookie Policy

These documents form a legally binding agreement.

4. Accounts

Users must:

• provide accurate information
• safeguard login credentials
• be legally capable of entering contracts

One account per user. The Operator may suspend or terminate accounts at its sole discretion for violations, fraud, or legal risk.

5. Membership and Paid Services

Certain features require a paid membership (multiple tiers).

Membership fees:

• provide access to platform tools only
• are not commissions or brokerage fees
• do not make the Operator part of transactions

No guarantee of sales or results. Plans, features, and pricing may change.

6. Listings and User Content

Users are solely responsible for their Content.

By posting Content, Users grant the Operator a non-exclusive, worldwide, royalty-free license to host and display it for Platform operation.

The Operator may remove content without notice.

7. Seller Classification

Professional Sellers must clearly identify business details and comply with EU consumer law. Misrepresentation may result in termination.

8. User Responsibility (CORE CLAUSE)

Users are fully responsible for:

• legality and accuracy of listings
• ownership/authenticity of goods
• compliance with tax and consumer laws
• communications with other users

The Operator does not pre-screen listings and cannot guarantee legality.

9. Prohibited Conduct

Users must not:

• sell illegal, stolen, or counterfeit goods
• post misleading content
• commit fraud
• impersonate others
• use bots
• interfere with platform security

10. Notice & Takedown (DSA-Aligned)

Users or third parties may report illegal or misleading content.

Upon receiving a report, the Operator may:

• review content
• request information
• remove listings
• suspend or terminate accounts

Removal does not make the Operator responsible for the transaction.

11. No Warranty Regarding Transactions

The Operator does not:

• guarantee payment
• guarantee delivery
• verify product quality
• authenticate goods

Users transact at their own risk.

12. Disputes Between Users

The Operator is not obligated to resolve disputes but may cooperate with authorities and provide logs when legally required.

13. Monitoring and Security

The Operator may monitor activity and use automated systems to detect fraud, abuse, or security threats.

14. Liability Limitation

To the maximum extent permitted by law, the Operator is not liable for:

• user actions
• transaction failures
• indirect damages
• loss of profits or data
• third-party services

15. Indemnification

Users agree to indemnify the Operator from any claims, damages, fines, or legal costs arising from:

• their listings
• illegal or misleading content
• breach of law
• disputes with other users

16. Intellectual Property

Platform software and branding belong to the Operator. Unauthorized use is prohibited.

17. Service Availability

The Platform is provided “as is” and may be modified, suspended, or discontinued at any time.

18. Data Protection

Personal data is processed under the Privacy Policy.

19. Governing Law

These Terms are governed by Slovenian law and EU law. EU consumers retain mandatory protections of their residence country.

20. Severability

If a clause is invalid, the rest remains effective.

21. Entire Agreement

These Terms constitute the entire agreement between Users and the Operator.

22. Changes

Terms may be updated. Continued use means acceptance.
